Course Description:

This course is based on a postgraduate/Master program and it will study the law governing the administrative state authority and entities, the role of the executive departments of the central government. Among other things, we will consider the constitutional foundations of the administrative law, studying the legal rules governing the organization of administrative authorities and the relationship between them and individuals, in addition to how to issue and implement administrative decisions and resolve disputes that arise between the administration and individuals. 

 The topic is viewed in terms of its relevance ,statutes, especially the Administrative Procedure Act, that govern administrative agencies, presidential control of administrative agencies; the role of agencies in interpreting statutes and regulations; and judicial review of agency action. A central theme is the tension between values associated with the rule of law (such as procedural regularity, transparency, democratic accountability, and reasoned decision-making) and the demands of effective executive action. 

This course examines the nature and scope of the power of administrative agencies and the restraints on administrative power imposed by the Constitution, statutes, and judicial decisions (case Laws).

Topics covered include the delegation of power to administrative agencies, administrative police, acts and contracts, liability and responsibilities, formal and informal decision-making processes and procedures, administrative adjudication and rulemaking, and judicial review of administrative actions. 

Learning Outcomes:

Upon completion of this course, students will:

·         Have a practical understanding of administrative law.

·         Understand how the concept of public service system is run.

·         Appreciate the limits that the law places on the administrative decision making powers

·         Be able to identify potential areas of the administrative activity toward the public order (administrative police, administrative contract and acts, administrative liability)

Prerequisites and Required knowledge:

The acquired knowledge and basic formation of the students in public service activity, administrative police, Administrative act and contract, administrative liability and legal concepts related to the formations that help in the study of administrative law. 

Course content:

The course content was designed and formed taking into account the elements related to the components of the basic aspects and levels of administrative law, and focusing on their importance in building basic knowledge for the CONCEPT OF PUBLIC - SERVICE in a smooth and simplified manner that allows the student to become familiar with the subject and its axes.

In order to study the subject, we divided it into six main axes, which are: 

The concept of public  service Session 

1: The public service system.

2: Administrative police.

3: The concept of unilateral administrative act .

4: The concept of administrative contract.

5: Administrative liability – Harmful act and generating event .

6: Administrative liability – Damage, causal link and person responsible.


 Learning objectives:

• The student of will be able to understand the most important component field of public service system process, especially viewing the external activities of the administration, especially taking decisions related to public order.

- The student will recognize the types and dimensions of the different Administrative activity levels and build the Ability to understand the background of problems and their dimensions

- The student will examine the Knowledge of the main administrative acts and contracts taken to solve problems and be aware of their concepts, and methods of administrative activity and how administrative decisions are made.

- The student will discover how to evaluate the administrative liability and responsibility toward its acts and activities.

• The student will learn the main Objectives of how to work through the existing public service system to bring about change in public policy in a way that achieves better success.

 

Assessment

Exam (100%) Final in the  programmed period.
